Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the SnapySplit mobile application or visiting snapysplit.app (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and SnapySplit ("we," "us," or "our"). Please read them carefully.

2. Description of Service

SnapySplit is a bill-splitting app available on iOS and Android. The Service allows you to:

• Scan receipts using AI-powered optical character recognition (OCR) to extract item details, prices, tax, and tip.
• Create groups and split bills among members with per-item or equal division.
• Send payment reminders via text and messaging to group members.
• Share payment links for third-party services like Venmo, Zelle, and Cash App.

The core features of SnapySplit are free. We may introduce optional premium features in the future, which will be clearly identified and priced before purchase.

3. Eligibility

You must be at least 13 years old to use SnapySplit. If you are between 13 and 18, you represent that you have your parent or guardian's permission to use the Service. By using SnapySplit, you represent and warrant that you meet these eligibility requirements.

4. User Accounts and Responsibilities

To use certain features of SnapySplit, you may need to create an account. You agree to:

• Provide accurate, current, and complete information when creating your account.
• Keep your login credentials secure and confidential.
• Notify us immediately at [email protected] if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or disable accounts that we reasonably believe have been compromised.

5. Acceptable Use

You agree not to use SnapySplit to:

• Violate any applicable laws or regulations.
• Send spam, harassing, threatening, or abusive messages through the reminder feature.
• Upload fraudulent, misleading, or manipulated receipt images.
• Attempt to gain unauthorized access to other users' accounts, data, or any part of the Service.
• Interfere with or disrupt the Service, its servers, or networks connected to SnapySplit.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code of the app.
• Use the Service for any illegal, fraudulent, or unauthorized purpose.
• Use automated systems, bots, or scripts to access or interact with the Service without our written permission.

We reserve the right to investigate violations and may suspend or terminate accounts that breach these Terms, with or without notice depending on the severity of the violation.

6. User Content

You retain ownership of any content you upload to SnapySplit, including receipt images, group names, and payment links ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to process, store, and display it solely as necessary to provide and improve the Service.

You represent that you have the right to upload any content you submit and that your User Content does not violate the rights of any third party.

We do not claim ownership of your User Content, and this license terminates when you delete your content or your account.

7. AI and OCR Accuracy

SnapySplit uses artificial intelligence and optical character recognition to scan and interpret receipt data. While we strive for accuracy, AI-generated results may contain errors, including incorrect item names, prices, tax calculations, or tip amounts.

You are responsible for reviewing and verifying all scanned data before finalizing any bill split. SnapySplit is not liable for disputes, financial losses, or other issues arising from inaccurate scan results that were not reviewed before use.

8. Payments and Third-Party Services

SnapySplit does not process, facilitate, or intermediate payments between users. When you share payment links (for Venmo, Zelle, Cash App, or similar services), those transactions occur entirely on those third-party platforms and are governed by their respective terms and policies.

SnapySplit is not responsible for any issues arising from third-party payment transactions, including but not limited to failed payments, incorrect amounts sent, unauthorized transactions, or disputes between users.

If we introduce premium features in the future, pricing and billing terms will be clearly presented before purchase. Paid features offered through the Apple App Store or Google Play Store will be subject to their respective billing and refund policies.

9. Intellectual Property

The SnapySplit Service, including its design, source code, AI models, algorithms, branding, logos, and content, is owned by SnapySplit and protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved.

You may not copy, modify, distribute, sell, lease, or create derivative works based on our Service or any part thereof without our prior written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. We do not guarantee the accuracy, completeness, or reliability of any AI-generated scan results.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPYSPLIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total aggregate liability for any claim related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) fifty dollars ($50.00 USD).

12. Indemnification

You agree to indemnify, defend, and hold harmless SnapySplit and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your User Content.

13. Termination

You may stop using SnapySplit and delete your account at any time through the app settings. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, extended inactivity, or discontinuation of the Service.

Upon termination, your right to use the Service ceases immediately. Sections 6, 9, 10, 11, 12, 15, and 16 of these Terms shall survive termination.

14. Dispute Resolution

If you have a dispute with SnapySplit, we encourage you to first contact us at [email protected] so we can try to resolve it informally.

If we are unable to resolve the dispute informally, you and SnapySplit agree that any legal action or proceeding shall be brought exclusively in the courts located in the United States, and you consent to the jurisdiction of such courts.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Your use of the Service may also be subject to other local, state, or federal laws.

16. General Provisions

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SnapySplit regarding the Service, superseding any prior agreements.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

17. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Notify you through the app or by email before material changes take effect.

Your continued use of SnapySplit after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you should stop using the Service and delete your account.
